Ruling allows Northstar to proceed with sale

An Ontario Superior Court judge has dismissed a motion from the  
Ministry of the Environment and ruled that Northstar Aerospace Inc.  
can proceed with the sale of its assets without continuing to pay for  
the environmental remediation of a Cambridge neighbourhood affected  
by noxious contamination from former plant operations on Bishop  
Street North.

The company filed for bankruptcy protection earlier this year.  
Efforts to remove trichloroethylene (TCE) contamination from the air,  
soil and groundwater have been ongoing since 2005. Many residents  
living in the surrounding area have equipment installed on their  
property to implement and test ongoing mitigation measures.

Tracy Hipel has a photocatalytic oxidization system hooked up to his  
furnace and a shed on his property that contains a soil vapour  
extraction unit. He said it costs him $1,700 a year to operate the  
equipment and that the company is covering the cost until July 31.  
After that, he's unsure who'll pay.

People will turn the units off if they aren't compensated for hydro  
costs, Hipel said.
