The case of the proposed expansion of the Dugway Proving Ground raises some interesting questions, since Dugway is an operational range. If the Defense Department ever wins passage of legislation that would to exempt munitions and related chemicals from regulatory oversight on such properties, what happens to the legal obligation to respond on a parcel that is contaminated now, is not yet an operational range, but which may become one?
